Fokana: Now what?

Tuesday, August 28th, 2007

The court verdict is not yet recieved. But TS Chacko group said the case was dismissed. George Koshy group claimed the case was postponed only.

Anyway, in one or two days the court papers will be available. It seems the court said that the election of all people was invalid.

NG Mathew, who gave the appeal to reconsider the case was also not sure about going further with the case. But he made it clear that the Houston convention will go on as decided and Sasidharan Nair-Aniyan George team will conduct the convention.

Let us wait for the complete picture.

Attorney Donald H. Nixon’s comments. He represented Thampy Chacko

The Hearing on August 27, 2007:

1.  First and most important, we won.

2.  The hearing did go on as scheduled.

3.  There were two attorneys representing the defendants, who are FOKANA and Mr. Mathew.  They were accompanied by approximately 15 persons who showed up as observers.  No one addressed the court except myself and Arnold Politzer, the attorney for the defendants.

4.  Mr. Politzer’s argument was that the Court’s Order of May 16, 2007 was a mistake and that it was (a) based on a faulty foundation and  (b) that T.S. Chacko had committed fraud in his assumption of the duties of Chairman of FOKANA.

5.  I argued that (a) that the defendants had waited too long to file any objection to the Order of May 26th (b) that Mr. Chacko’s actions were supported by the By-laws of the organization once the election of 6/30/06 was voided and (c) that any actions taken by the Board of Trustees meeting of August 19, 2006 were void because of the voided election of 6/30/06.

6.  The Judge agreed with me and DENIED the motion of the Defendants to modify the Order of May 16, 2007 which remains the ruling of the court.  And once again, that Order is that the election of 6/30/06 is null and void.

7.  There was no postponement as Thampy Chacko was informed.  There was a hearing and the judge gave his decision in open court.

8.  The matter is settled in the Circuit Court for Montgomery County, Maryland.  Of course, the other group could appeal the decision of Judge Johnson to the Maryland Court of Special Appeals.  I am just as sure they will lose at the Court of Special Appeals, if they do.

Worth of pennies-everyday wisdom

Saturday, August 25th, 2007

You always hear the usual stories of pennies on the sidewalk being good luck, gifts from angels, etc. This is the first time I’ve ever heard this twist on the story. Gives you something to think about.
Several years ago, a friend of mine and her husband were invited to spend the weekend at the husband’s employer’s home. My friend, Arlene, was nervous about the weekend. The boss was very wealthy, with a fine home on the waterway, and cars costing more than her house
The first day and evening went well, and Arlene was delighted to have this rare glimpse into how the very wealthy live. The husband’s employer was quite generous as a host, and took them to the finest restaurants. Arlene knew she would never have the opportunity to indulge in this kind of extravagance again, so was enjoying herself immensely.

As the thre e of them were about to enter an exclusive restaurant that evening, the boss was walking slightly ahead of Arlene and her husband.
He stopped suddenly, looking down on the pavement for a long, silent moment.

Arlene wondered if she was supposed to pass him. There was nothing on the ground except a single darkened penny that someone had dropped, and a few cigarette butts Still silent, the man reached down and picked up the penny.

He held it up and smiled, then put it in his pocket as if he had found a great treasure. How absurd! What need did this man have for a single penny? Why would he even take the time to stop and pick it up?

Throughout dinner, the entire scene nagged at her. Finally, she could stand it no longer. She casually mentioned that her daughter once had a coin collection, and asked if the penny he had found had been of some value.

A smile crept across the man’s face as he reached into his pocket for the penny and held it out for her to se e. She had seen many pennies before! What was the point of this?

“Look at it.” He said. “Read what it says.” She read the words “United States of America ”
“No, not that; read further.”
“One cent?” “No, keep reading.”
“In God we Trust?” “Yes!” “And?”
“And if I trust in God, the name of God is holy, even on a coin. Whenever I find a coin I see that inscription. It is written on every single United States coin, but we never seem to notice it! God drops a message right in front of me telling me to trust Him? Who am I to pass it by? When I see a coin, I pray, I stop to see if my trust IS in God at that moment. I pick the coin up as a response to God; that I do trust in Him. For a short time, at least, I cherish it as if i t were gold. I think it is God’s way of starting a conversation with me. Lucky for me, God is patient and pennies are plentiful!

When I was out shopping today, I found a penny on the sidewalk. I stopped and picked it up, and realized that I had been worrying and fretting in my mind about things I cannot change. I read the words, “In God We Trust,” and had to laugh. Yes, God, I get the message.

It seems that I have been finding an inordinate number of pennies in the last few months, but then, pennies are plentiful! And, God is patient..

Take my son- thoughts for the day

Saturday, August 25th, 2007

Take my Son
This is great, take a moment to read it, it will make your day; and the ending will surprise you!

Take my Son
A wealthy man and his son loved to collect rare works of art. They had everything in their collection, from Picasso to Raphael. They would often sit together and admire the great works of art.

When the Vietnam conflict broke out, the son went to war. He was very courageous and died in battle while rescuing another soldier. The father was notified and grieved deeply for his only son.

About a month later, just before Christmas, there wa s a knock at the door. A young man stood at the door with a large package in his hands.

He said, ‘Sir, you don’t know me, but I am the soldier for whom your son gave his life. He saved many lives that day, and he was carrying me to safety when a bullet struck him in the heart and he died instantly. He often talked about you, and your love for art.’ The young man held out this package. ‘I know this isn’t much. I’m not really a great artist, but I think your son would have wanted you to have this.’

The father opened the package. It was a portrait of his son, painted by the young man. He stared in awe at the way the soldier had captured the personality of his son in the painting. The father was so drawn to the eyes that his own eyes welled up with tears. He thanked the young man and offered to pay him for the picture. ‘Oh, no sir, I could never repay what your son did for me. It’s a gift.’

The father hung the portrait over his mantle. Every time visitors came to his home he took them to see the portrait of his son before he showed them any of the other great works he had collected.
The man died a few months later. There was to be a great auction of his paintings Many influential people gathered, excited over seeing the great paintings and having an opportunity to purchase one for their collection.

On the platform sat the painting of the son The auctioneer pounded his gavel. ‘We will start the bidding with this picture of the son. Who will bid for this picture?’

There was silence.

Then a voice in the back of the room shouted, ‘We want to see the famous paintings. Skip this one.’

But the auctioneer persisted. ‘Will somebody bid for this painting? Who will start the bidding? $100, $200?’

Another voice angrily. ‘We didn’t come to see this painting. We came to see the Van Goghs, the Rembrandts. Get on with the real bids!’

But still the auctioneer continued. ‘The son! The son! Who & will take the son?’

Finally, a voice came from the very back of the room. It was the longtime gardener of the man and his son. ‘I’ll give $10 for the painting.’ Being a poor man, it was all he could afford.

‘We have $10, who will bid $20?’

‘Give it to him for $10. Let’s see the masters.’

‘$10 is the bid, won’t someone bid $20?’

The crowd was becoming angry. They didn’t want the picture of the son.

They wanted the more worthy investments for their collections.

The auctioneer pounded the gavel. ‘Going once, twice, SOLD for $10!’

A man sitting on the second row shouted, ‘Now let’s get on with the collection!’

The auctioneer laid down his gavel. ‘I’m sorry, the auction is over.’

‘What about the paintings?’

‘I am sorry. When I was called to conduct this auction, I was told of a secret stipulation in the will. I was not allowed to reveal that stipulation until this time. Only the painting of the son would be auctioned. Whoever bought that painting would inherit the entire estate, including the paintings.

The man who took the son gets everything!’

God gave His son 2,000 years ago to die on the cross. Much like the auctioneer, His message today is: ‘The son, the son, who’ll take the son?’

Because, you see, whoever takes the Son gets everything.

FOR GOD SO LOVED THE WORLD HE GAVE HIS ONLY BEGOTTEN SON, WHO SO EVER BELIEVETH, SHALL HAVE ETERNAL LIFE… THAT’S LOVE

Do whatever you like, but remember that maybe ‘one’ of the people you might have taken the time to send this to, may be just the person who needs to hear this message. You have a choice to make.’
God Bless!

Thursday, August 9th, 2007

Dear Friends,

Please send your request to the legal and real Chairman of FOKANA BOARD OF TRUSTEES to seek an amicable solution to the standoff and to  conduct the convention as planned.

This is the  address of:

Mr. T. S. Chacko, Chairman

FOKANA BOARD OF TRUSTEES

399  Graphic Blvd

Newmilford, NJ 07646

E-mail: nethavu@yahoo.com

Tel: 201-262-5979

Cell: 201-889-0750

Please forward this e-mail to your friends.  Thanks.

Please contact the real and legal Chairman of the FOKANA Trustee Board and let him call for the General Body Meeting.  I do not believe that George Koshy is the one whom you should contact. The court in Rockville , Maryland voided the elections of 2006.  And more over he NEVER submitted the FOKANA CONNVENTION ACCOUNTS to the TRUSTEE BOARD and clear the accounts.

With best wishes,

Dear Mr. Chairman:

We are deeply concerned about the current crisis in FOKANA. After talking to many members in our Association we feel that there should be some kind of an immediate action to save FOKANA from its current crisis. The viable option we believe that you should call for a General council meeting as early as possible. In that meeting we can discuss and resolve any or all issues since general council is the supreme authority of FOKANA.

Hope to hear from you soon,

Sincerely,

Dear Mr. Chairman:

It is with great sorrow we inform you that we are saddened by the current crisis in FOKANA. It is quiet evident from the news reports that some people are determined to destroy FOKANA and that should not happen.

To avoid destruction to FOKANA could you kindly call for a General Council meeting? Since General Council is the supreme authority of FOKANA we can discuss and make appropriate decisions which will save FOKANA from its current crisis.

Please let us know, if we can be any help to you,

Sasidharan Nair’s letter

Dear Editor,
Staten Island Malayalee association ’s decision is very encouraging and appreciative. It is nice to know , now some of us show the courage to tell the truth and ridicule the wrong.I wish more and more associations come forward and support the truth . This will help to eliminate the stagnation of present situation and we can rejuvenate our organization. So I request all malayalee associations to send a request to George Koshy the present trustee board chairman authorizing him  to call a General Council .This letter shall be send as early as possible.
Also at this time I appeal to all Association officials, fokana friends to help the suffering poor sick population in Kerala so that they can have a decent Onam. Also I appeal to the deprived fokana officials,we can still do the charity with out a title.
Let us work together and help the needy.

Editorial in Malayalam Pathram

I read the editorial of Malayalam Pathram on Fokana issue with great satisfaction. I fully agree with the observations made by this leading malayalam print media in America. Thanks Malayalam Pathram for giving  very positive and feasible solutions through your editorial.

Hope, all those love Malayalee community of America and all the present and past leaders of FOKANA will understand and respond positively to resolve all issues in FOKANA . The World Malayalee Council will always support and work with FOKANA and do whatever is possible to help its leaders to resolve all issues without going into any litigation.  The policy of WMC is to work with all Kerala associations and non-profit organizations of Malayalees all over the world.

It is already late that we Malayalee immigrants estabish our identity and status with the American main stream communities. Unless we stand united nobody and no govt or political entity in America will recognize us as a powerful immigrant group. Let us resolve all issues within our organizations as quickly as possible  and work together to project our identity as a powerful group/force that we legitimately deserve in the American political arena.

Sincerely,

Alex Vilanilam Koshy
WMC Global President

Fokana: Orlando convention ends in small profit

Wednesday, August 1st, 2007

The Fokana convention in Orlando ended with a profit of $1004, accounts passed by the national committee that met in Tampa, Florida, on Sunday, shows.

The accounts present a total of $651,530 as receipts. The expenses were totaled as $650,525 and the balance is $1004.

A press note from John Issac, former general secretary, said that the accounts were presented by Aney Paul, former joint treasurer, in the absence of treasurer Mathew Varghese.

The accounts were presented by Mathew Varghese at a meeting held in New York in May. But the meeting had no quorum then, so it had to be postponed, the note said.

Former president George Korath, John Issac and former vice president Alex Thomas answered the many questions from the members.

After a long discussion the accounts were passed. Bose Varghese from Washington, proposed it and Denny Uralil from Florida supported.

The meeting authorized Korath to handover the accounts to the trustee board chair TS Chacko.

Korath thanked Mathew Varghese for his efforts to prepare the accounts. He also thanked the auditors, Vincent Immanuel and Suda Kartha of Philadelphia.

He expressed his gratitude to the committee members, trustee board members, and convention committee members for their tireless work and help during his term in office.

He was also thankful to those who attended the convention and those helped financially to make it a grand success. He also mentioned the role played by the media and thanked for their support.

Denny Uralil welcomed the gathering. Alex Thomas proposed a vote of thanks.

Though the accounts show a balance, indications are that some of the officials gave money to avoid a loss.

The last two conventions, in Chicago and New Jersey, were ended in loss. In Chicago, it was the officials who contributed their money to make it break even.

The auditors had two negative comments. 1) Receipts and disbursements were not arranged in an order. 2) A balance sheet was not provided listing all assets and liabilities.

“We appreciate your dedicated service and valuable time in serving the North American Malayalee community through Fokana during 2004-2006 and coordination of the Florida convention. Except for those items mentioned above, our audit reveals that the accounts presented found satisfactory,” the audit report said.

Meanwhile, Mathew Varghese said he does not agree with the accounts. He said he was not given the details of accounts in Kerala. He also said that he was not properly informed of the Tampa meeting. He got only a message in his voicemail from Korath on that day mentioning about the meeting.

But John Issac said Mathew Varghese did not bring any objection during auditing.

Following is the account.
